1. Agreement to Terms

By accessing or using SyncMySalon ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

SyncMySalon is an AI-powered booking assistant service that enables salon owners and stylists to manage appointments, schedule services, and interact with clients through automated chat interfaces. The Service includes:

  • AI-powered booking and scheduling functionality
  • Client communication tools (web chat, and future integrations with WhatsApp and Instagram)
  • Team and stylist management features
  • Calendar integration and synchronization
  • Analytics and reporting tools
  • Customizable branding and booking pages

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Responsibility

You are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Ensuring that all information provided is accurate and up-to-date
  • Notifying us immediately of any unauthorized use of your account

4. Subscription Plans and Payment

4.1 Subscription Tiers

SyncMySalon offers various subscription plans with different features and limitations. Current plans include:

  • Launch Trial: Free 30-day trial with full access to Growth plan features
  • Starter: €15/month for solo stylists
  • Growth: €35/month for small teams (up to 5 stylists)
  • Pro Studio: €59/month for multi-stylist salons (up to 10 stylists)

4.2 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fees. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

4.4 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Usage Limits and Restrictions

5.1 Conversation Limits

Each subscription plan includes a monthly conversation limit. Exceeding these limits may result in:

  • Temporary suspension of booking functionality
  • Automatic upgrade prompts to a higher tier
  • Additional charges for overage (if applicable to your plan)

5.2 Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Share your account credentials with unauthorized parties
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Content and Data

6.1 Your Content

You retain ownership of all content you upload to the Service, including service information, stylist details, and client data. By using the Service, you grant us a license to use, store, and process this content solely for the purpose of providing the Service.

6.2 Client Data

You are responsible for ensuring that you have the necessary consent and legal basis to collect, store, and process client data through the Service. You must comply with all applicable data protection laws, including GDPR.

6.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backups of important data. We are not liable for any loss of data.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by SyncMySalon and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Force majeure events
  • Third-party service disruptions

We are not liable for any damages resulting from Service unavailability.

9. Termination

9.1 Termination by You

You may terminate your account at any time by cancelling your subscription through your account settings. Upon termination, your access to the Service will cease at the end of your current billing period.

9.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Misuse the Service in any way

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data after a reasonable retention period, subject to legal requirements.

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by law, SyncMySalon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless SyncMySalon and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SyncMySalon regarding the Service and supersede all prior agreements and understandings.
